Bandar Lampung – Srikandinews.com. Menanggapi surat Kapolres Pringsewu, AKBP M. Yunnus Saputra, SIK, M.Sc.IT yang ditujukan kepada Penjabat Bupati Pringsewu Cq. Kepala Dinas Pendidikan Dan Kebudayaan Pringsewu, Kepala Pekon /Lurah Kab. Pringsewu, terkait pengembangan kasus pemerasan terhadap Kakon/Lurah serta himbauan hubungan kemitraan dengan Media dan Wartawan, maka Forum Pers Independent Indonesia (FPII) Provinsi Lampung yang merupakan salah satu Organisasi Pers yang ada di tingkat Nasional dan Provinsi Lampung, bersikap.
Pertama, FPII Prov. Lampung mengucapakan selamat kepada jajaran Kepolisian Pringsewu yang telah mengamankan dan menahan Oknum Wartawan yang diduga telah melakukan tindakan melawan hukum dengan melakukan pemerasan. FPII Lampung mensuport Polres Pringsewu untuk melakukan menegakan hukum kepada Oknum-Oknum Wartawan yang melakukan pemerasan. Ini tentunya akan memberikan efek jera bagi oknum wartawan lain yang akan melakukan hal serupa, karena perbuatan pemerasan atau pelanggaran akan memberikan dampak luas kepada teman-teman se-Profesi.
FPII Prov. Lampung juga tidak hanya mendorong dan mensupport Polres Pringsewu dalam penegakkan hukum untuk oknum wartawan yang nakal saja, tapi menitipkan pesan kepala jajaran Polres Pringsewu untuk menidak Kepala Pekon/Lurah, Kepala Sekolah, Camat, ASN, Pejabat Daerah bahkan Anggota Kepolisian sendiri yang terbukti melakukan pelanggan hukum secara objektif tanpa pandang bulu, agar tercipta rasa keadilan di tengah masyarakat.
Kedua, FPII Prov. Lampung juga patut meluruskan pernyataan Kapolres Pringsewu yang mengatakan bahwa untuk tidak melayani situs atau media yang tidak terdata di webesite Dewan Pers https://dewanpers.or.id/data/perusahaan pers. Agar tidak ada salah pemahaman yang dapat menimbulkan kegaduhan di kalangan Pegiat media, apalagi bertepatan dengan pelaksanan kampanye Pilkada 2024, seluruh masyarakat diminta menjaga ketenangan dan kenyamanan di tengah masyarakat agar Pilkada dapat berjalan dengan aman dan tertib.
Perlu diketahui, tidak satupun aturan yang menjelaskan bahwa Perusahaan Media harus berada dan terverifikasi dan di bawah naungan Dewan Pers saja yang dapat diakui. Dan tidak ada satupun aturan yang mengatur bahwa media yang tidak terdata di Dewan Pers tidak boleh dilayani. Sesuai UU No. 40 tahun 1999 tentang Pers. Dewan Pers bukan melakukan verifikas, melainkan bertugas melakukan pendataan.
Banyak faktor sehingga Dewan Pers belum dapat mendata seluruh perusahaan media. Diantaranya, keterbatasan sumber daya dan jumlah Pengurus Dewan Pers, serta pesatnya perkembangan media sehingga menyulitkan Dewan Pers melakukan pendataan.
Selain itu, sesuai amanah UU No. 40 tahun 1999 tentang Pers menjelaskan, bahwa setiap wartawan berhak memilih/bernaung di Organisasi Pers sesuai keinginannya. Ini membuktikan bahwa Organisasi Pers tidak hanya satu, melainkan banyak. Dan, diantara Organisasi Pers yang ada tersebut, tidak semuanya bernaung di Dewan Pers.
Jadi, poin pentingnya bahwa Dewan Pers bukan Penentu legal atau tidak legalnya sebuah media atau wartawan dalam melaksanakan tugas jurnalistik. Ketentuan legalitas perusahaan media adalah ketika sudah memenuhi persyaratan dan sudah terdaftar di Negara melalui Kemenkumham dibuktikan dengan dikeluarkannya surat legalitas bahwa perusahaan media tersebut memiliki AHU oleh Kemenkumham Republik Indonesia.
Hal ini juga diperkuat oleh keterangan Ketua Dewan Pers, Ninik Rahayu, Dr. Ninik Rahayu, S.H., M.S., menyebut, berdasarkan Undang-Undang Nomor 40 Tahun 1999 tentang Pers pada waktu lahir tidak mengenal pendaftaran bagi perusahaan pers.
“Setiap orang dapat mendirikan perusahaan pers dan menjalankan tugas jurnalistik tanpa harus mendaftar ke lembaga mana pun, termasuk ke Dewan Pers,” kata Dr. Ninik dalam keterangan resminya, Kamis (4/4/2024).
Setiap perusahaan pers, lanjut dia, sepanjang memenuhi syarat berbadan hukum Indonesia seperti PT, menjalankan fungsi tugas jurnalistik secara profesional dan teratur, dapat disebut sebagai perusahaan pers meski belum terdata di Dewan Pers.
Hal ini diatur dalam Pasal 9 ayat (2) Undang-Undang Pers dan Kode Etik Jurnalistik. Sementara itu, dalam Pasal 15 ayat 2 (huruf g) Undang-Undang Pers, tugas Dewan Pers adalah mendata perusahaan pers.
Begitupun Uji Kompetensi Wartawan (UKW) bukanlah syarat bagi seseorang untuk menjadi wartawan di Indonesia. UKW bukanlah perintah dan atau amanat dari Undang-Undang Pokok Pers.
Ketiga, FPII Provinsi Lampung meminta kepada Kapolres Pringsewu, AKBP M. Yunnus Saputra, SIK, M.Sc.IT, untuk mencabut pernyataannya yang mengatakan, untuk tidak melayani situs atau media yang tidak terdata di webesite Dewan Pers https://dewanpers.or.id/data/perusahaanpers. Hal ini akan menjadi polemik di kalangan pers dan akan menjadi preseden buruk kinerja Kapolres Pringsewu yang sebenarnya tak memahami UU No. 40 tahun 1999 tentang Pers itu sendiri.
“Apa yang disampaikan Kapolres Pringsewu dapat memicu polemik di kalangan pers, baik di Provinsi Lampung maupun Nasional. Saya harap Kapolres Pringsewu segera mencabut pernyataannya. Pahami dulu UU No. 40 tahun 1999 tentang Pers, baru berpendapat,” ujar Ketua FPII Provinsi Lampung, Aminudin, S.P dalam release yang diterima Redaksi Media ini, Kamis (31/10/2024), menyikapi surat himbauan hubungan kemitraan dengan media dan wartawan yang dikeluarkan Polres Pringsewu tanggal 28 Oktober 2024.
